Health Information and HIPAA

Protected health information created or maintained in the course of your care is governed by the Health Insurance Portability and Accountability Act (HIPAA) and by our Notice of Privacy Practices, which is provided to patients and available on request. This Privacy Policy addresses information collected through our website and general business communications.

Information We Collect

Information you provide:

  • Date of birth and, where applicable, the name of a parent or guardian
  • Information you share about your injury, symptoms, or reason for contacting us
  • Insurance, employer, attorney, or claim information relevant to your care or billing
  • Referral information provided by a physician, therapist, coach, attorney, or other referring party

Information collected automatically:

  • Browser type and version, operating system, and device type
  • IP address
  • Pages visited and time spent on the website

How We Use Your Information

  • To schedule, provide, and coordinate evaluations, diagnostic testing, and treatment
  • To communicate with you about appointments, results, and follow-up care
  • To respond to inquiries submitted through our website, by phone, by email, or by text message
  • To coordinate with referring providers and, where you have authorized it, with other parties involved in your care or claim
  • To process insurance, billing, and program eligibility, including the Headstrong Concussion and Sports Injury Insurance Program

Text Messaging (SMS)

TouchPoint may send text messages to patients who have provided a mobile number and consented to receive them. Consent is obtained directly from the patient during a telephone conversation with our staff. We do not send unsolicited or cold text messages, we do not publish a keyword or short code, and a referral from a physician, therapist, coach, attorney, or insurer is never treated as the patient’s consent to receive text messages.

For patients under 18, consent to receive text messages is obtained from a parent or legal guardian, and messages are sent to the number that parent or guardian provides.

Messages may include appointment confirmations and reminders, scheduling of diagnostic testing and follow-up visits, treatment coordination, requests for records or documentation, and responses to questions you have asked us. We do not send marketing or promotional text messages.

Message frequency varies based on your care and is typically two to eight messages per month while you are in active treatment. Message and data rates may apply.

You may opt out at any time by replying STOP to any message, after which you will receive one confirmation message and no further messages. Reply HELP to any message, or call 314-900-0691, for assistance. Consent to receive text messages is not a condition of receiving care.

We do not sell, rent, or share mobile phone numbers or text messaging consent with third parties or affiliates for their own marketing purposes. Mobile information collected for text messaging is used solely to communicate with you about your care.

Sharing Your Information

We do not sell your personal information. We share information only as necessary to:

  • Provide care, including with the physicians, technologists, and clinicians involved in your evaluation and treatment
  • Coordinate with a referring provider, or with another party where you have authorized the release in writing
  • Process insurance claims, billing, and program eligibility
  • Work with service providers who support our operations and are obligated to protect your information
  • Comply with legal obligations, court orders, subpoenas, or other lawful requests

As stated above, mobile phone numbers and text messaging consent are never shared with third parties for marketing purposes.

Minors

We provide care to minors, including student athletes. Our website is not directed to children, and we do not knowingly collect information online from a child without the involvement of a parent or legal guardian. Where a patient is under 18, a parent or legal guardian provides the contact information and consents to communications on the patient’s behalf.

Data Security

We maintain administrative, technical, and physical safeguards designed to protect the information we hold against unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send detailed medical information through the website contact form or by text message; call us instead.

Your Rights

  • Request a copy of your medical records, and request amendment of those records, as provided under HIPAA and our Notice of Privacy Practices
  • Request deletion of information we hold, subject to our legal and recordkeeping obligations
